Illinois Teen Wins DUI Appeal
Another big win for DUI Defense Attorneys yesterday as a Wisconsin Appeals Court on Wednesday commended an Illinois teen for doing the right thing by trying to sleep off his alcohol buzz, and said the trial court was wrong not to let him argue that police had entrapped him.
Court rules in favor of drunk sleeping it off in car
An Illinois teen knew he was too drunk to drive home after a Dave Matthews Band concert south of Milwaukee. So he fell asleep in his car, only to be awoken by a state trooper.
Travis Peterson, 19, of Dixon, Ill., said even though he told the officer he was drunk and sleeping it off, the trooper ordered him to leave because the lot was being cleared.
Once out of the parking lot, Peterson was arrested for drunken driving. He was subsequently found guilty and ordered to spend 60 days in jail.
DUI Supreme Court Case Favorable To Defendants
A very interesting ruling came down from the California Supreme Court allowing defendants to challenge Breathalyzer results. For years, our DUI attorneys have challenged the admissibility of Breathalyzer results, often winning on many of the issues that we raise. Now the California Supreme Court affirms the defendant’s right to challenge the DUI evidence against them.
California Supreme Court says defendants can challenge Breathalyzer results
The court permits drunk-driving defendants in some cases to question blood-alcohol findings, which are sometimes inaccurate depending on factors such as gender and medical conditions.
Accused drunk drivers now have more ammunition for challenging Breathalyzer findings as a result of a unanimous ruling Thursday by the California Supreme Court.
The ruling is expected to make drunk-driving cases more complicated and possibly more difficult to prosecute, lawyers said. Courts in two other states, Arizona and Vermont, have reached similar conclusions.

DUI Checkpoint: 1,131 Stopped, No DUIs
Drunk Driving checkpoints exist as a “DUI exception” to the 4th Amendment and an infringement on people’s Constitutional Right to be free from unreasonable search and seizure. These checkpoints have increasingly been popping up all across the Nation. But what are the checkpoints accomplishing? The article below sees to suggest that these checkpoints are more about generating revenue than catching drunk drivers.
DUI checkpoint stops 1,131 vehicles
A DUI checkpoint over the holiday weekend resulted in 10 people being arrested and more than 100 drivers being issued traffic citations.
The Florida Highway Patrol arranged for the checkpoint to be set up in the 2500 block of Southwest 13th Street in Gainesville between 10 p. m. Friday until 2 a.m. Saturday. FHP Lt. Pat Riordan said that during that time, 1,131 vehicles were checked.

Two DUIs in Five Hours For Woman
Our Chicago Attorneys have reported just recently on the man who was arrested on a DUI one day after being released from jail on a previous DUI complaint and woman arrested for dunk driving 4 times in 3 weeks, but we don’t believe that our DUI Lawyers have ever seen a turnaround quite this quick before:
Md. woman arrested twice in 5 hours for driving under the influence of alcohol
OCEAN CITY, Md. (AP) — Police arrested a Woodbine, Md. woman twice in five hours on charges of driving under the influence of alcohol. Police said a 20-year-old woman was swerving across lane markers and failed to stop at a stop sign about 2:15 a.m. Friday. Our Chicago DUI Lawyers have learned that former TV star Joyce DeWitt, known best for her role as Janet Wood on the TV show “Three’s Company”, was arrested and charged for with drunk driving.
Three’s Company” Star Arrested for DUI Mr. Furley would be so disappointed
Perhaps, like so many episodes of “Three’s Company,” it’s all just a big misunderstanding.
Perhaps not.
El Segundo, Calif., police say they saw actress Joyce DeWitt drive through a barricade near a park just before 4:20 p.m. on the Fourth of July. And then when she was stopped an officer “observed signs and symptoms” of intoxication. After a series of field sobriety tests, she was arrested, according to Sergeant Danny Kim.
