Police arrest DUI lawyer for driving drunk
A prominent DUI lawyer may be in need of a good attorney himself after police arrested him for a suspected drunken hit and run Wednesday night.
Police say attorney John Higgins got abusive when they confronted him after his BMW hit a curb. He allegedly threatened to go after the arresting officers’ badges for detaining him.
Just after 6 p.m., police were called to Albuquerque’s Old Town. Residents told cops they’d seen a man hit a curb so hard that the tire on the 2004 BMW was blown out.
Police found the 65-year-old Higgins blocks away allegedly reeking of booze and insisting he wasn’t driving. They say Higgins walked away from the crash and denied ever driving drunk.
A witness says he saw Higgins being verbally abusive to police.
“He was cussing loud enough for me to hear him inside. The driver did make some comments to the officers that they were somehow going to lose their job or that he was going to report them to the FBI,” the witness said.
Police said Higgins refused to take a field sobriety test or breath test, so they charged him with aggravated DUI. He was also charged with leaving the scene of an accident.
This isn’t Higgins first run-in with police. In 2001, he was charged with DUI.
