A judge threw out evidence in three drunken driving cases Thursday because the sheriff’s office did not follow its plan for a DUI checkpoint on U.S. 41 in Palmetto, Florida.
The ruling cripples the DUI cases, and defense attorneys already are planning to file similar motions that would challenge cases from that checkpoint and four or five others in the county.
The law requires specific plans for the checkpoints that limit the decisions deputies can make at the scene. That aims to prevent officers from picking and choosing who to stop for any unlawful reason, such as racial profiling.
